Uniform Planned Community Act

Codified at 68 Pa.C.S. §§ 5101-5414, the UPCA governs creation, alteration, termination, and management of planned communities. It generally applies to communities of more than twelve units created on or after February 3, 1997, subject to the exceptions in § 5102.

Uniform Condominium Act

Condominiums are governed by 68 Pa.C.S. §§ 3101-3414, covering condominiums created after the Act took effect in 1980. Much of the financial and governance structure parallels the UPCA, but the applicability rules differ.

Records, disclosure, and assessment liens

Both Acts address financial record maintenance, annual disclosure, and open board meetings, and both provide for an association lien for unpaid assessments, with a limited priority over a prior mortgage in defined circumstances. How that applies to any particular account is a question for your counsel — our role is making sure the underlying assessment records are accurate and current.
