South Carolina Homeowners Association Act

Title 27, Chapter 30 of the South Carolina Code sets definitions, recording requirements that determine whether governing documents are enforceable, rules around association regulations, and notice requirements before adopting annual budget increases.

Budget increase notice

The Act requires notice before an annual budget increase takes effect. That is a scheduling problem more than a legal one: the budget has to be finished early enough for notice to go out on time, which is why we work backward from your fiscal calendar.

Access to documents and dispute jurisdiction

The Act addresses owner access to association documents and gives magistrates court jurisdiction over certain monetary disputes between associations and homeowners. It also established a division under the Department of Consumer Affairs for HOA matters.
